Trust and Estate Disputes
Trust and Estate Disputes
What we do
Our team handles all kinds of trust and estate disputes. Whether it’s a family trust falling apart or a dispute over a will.
How we can help
We recognise that trust and estate disputes almost always involve unique and often difficult family dynamics and a significant history. These issues are often sensitive and, as such, we aim to resolve such claims privately and sensibly in order to keep private matters private. Our first port of call to resolve disputes of this nature will usually be mediation, negotiations, or private arbitration. However, often things do need to go to court and if they do, we’ll have your back all the way through New Zealand’s court system.
What we have done
Acted in proceedings seeking the removal and/or appointment of additional trustees
Acted for trustees in seeking the assistance of the Court to vary and/or wind up trusts or for directions regarding the ongoing management of a trust
Acted for both executors and for claimants in relation to claims under the Family Protection Act and claims of undue influence or lack of capacity
Representedtrustees in a messy family trust dispute over trust arrangements and how wealth should be distributed
Acted for trustees in proceedings brought by beneficiaries alleging breach of trust and in relation to enforcing trustee indemnities
Obtained court approval under urgent circumstances for the manager of a terminally ill person under the Protection of Personal and Property Rights Act to execute a will on behalf of that person
