Family Law

What we do

There are those who may never need to seek the advice of a family lawyer. However, for many people, separation can be fraught with practical, financial and emotional challenges which cannot be overcome without professional advice. We provide services relating to care of children, guardianship disputes, child support reviews, and family violence matters (protection orders).

We also assist parties seeking advice and/or Court orders relating to the Protection of Personal and Property Rights Act (PPPR) in respect of persons (usually elderly) who have lost capacity to make their own decisions about their property and well-being.

We separately address relationship property matters here.

How we can help

If you and your ex-spouse or partner are unable to agree on who should care for the children and when, then we can provide pragmatic and effective advice on how to resolve the impasse. In many cases, clearer heads eventually prevail and with the right encouragement, parties will recognise what arrangements are in their children’s best interests and act accordingly.

However, if the parties cannot agree, then an application to the Family Court may be the only option, whether that is to resolve questions of day-to-day care and contact, where the children should live or where they go to school. We can guide you through the Court process and pre-requisites, provide advice on your prospects of success and the likely outcome from Court proceedings.

What we have done

  • Provided advice and guidance on the Family Court process as it relates to the care of children and/or protection orders

  • Acted for parents by negotiating with the other parent, applying to the Family Court and through mediation to secure better and more substantial contact with their children

  • Acted for the applicant in applying for parenting, protection, occupation and furniture orders, to secure a safe place for the applicant and their children to live following separation

  • Acted for the respondent in defending against those kinds of parenting and protection order applications

  • Acted for the applicant in applying to prevent the other parent from relocating to a different city/country with the children, and in some cases opposing those kinds of applications

  • Acted for one parent seeking orders that their children are enrolled in specific schools

  • Acted for adult children seeking Court orders and guidance around decision-making for their elderly parents
